Terms of Service

1. Acceptance and who we are
These Terms of Service (the “Terms”) govern your access to and use of Is It Disposable (isitdisposable.com), a commercial disposable email address detection service (the “Service”) operated by IdeasJam LLC (“we”, “us”, or “our”).
By creating an account, subscribing to a plan, or using the Service, you agree to these Terms. If you are accepting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree, do not use the Service.
These Terms form a binding agreement between you and us. Please read them carefully.
2. Description of the Service
Is It Disposable is a real-time application programming interface (API) and drop-in JavaScript snippet that detects whether an email address belongs to a disposable or throwaway provider. For each address you submit, the Service returns a core disposable verdict along with optional adjacent signals, and a recommended action (allow, warn, or block).
Detection is performed at the Domain Name System (DNS) level only, by inspecting Mail Exchange (MX), A, and AAAA records. The Service never performs Simple Mail Transfer Protocol (SMTP) mailbox probing of any kind.
The Service returns a recommended action; it never blocks a transaction on your behalf. Your form or application code is responsible for reading the returned action and deciding how to respond to it.
When you reach 100 percent of your plan quota, the Service continues to return a safe, non-blocking response (HTTP 200, checked false, action allow) so that your forms and flows never break. You will receive warnings by email and in-dashboard at 80, 90, and 95 percent of quota, each sent once per billing period.
3. Accounts
To use the Service you must create an account. You agree to provide accurate, current, and complete information, and to keep it up to date.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you believe your account has been compromised.
Signup requires a valid, non-disposable, deliverable email address. The Service runs its own detection at signup and will reject addresses from disposable or undeliverable providers. Relay, forwarding, and major public email providers are permitted.
You may invite team members to your account. Each person you add must agree to these Terms. You are responsible for the actions of anyone who accesses your account through a seat you have granted.
4. Acceptable use
You agree to use the Service only in accordance with these Terms and all applicable laws. In particular, you agree not to:
- Submit email addresses that you do not have a legitimate right or reason to check. You must have collected those addresses lawfully and must have a valid business purpose for verifying them.
- Resell, redistribute, or sublicense the detection data or verdicts returned by the Service to third parties without our prior written permission.
- Scrape or systematically harvest verdicts in order to build a competing detection dataset.
- Attempt to circumvent, reverse-engineer, or exploit the detection logic, algorithms, or infrastructure of the Service.
- Exceed rate limits, intentionally overload our systems, or use the Service in a way that degrades performance for other customers.
- Use the Service to facilitate fraud, spam, harassment, or any other unlawful activity.
We reserve the right to suspend or terminate accounts that violate these use restrictions without prior notice.
5. Subscriptions and billing
The Service is available by paid subscription only. We do not offer a pay-as-you-go option. Plans are available on a monthly or annual billing cycle.
Payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis at the start of each billing period. We do not store your full payment card number; Stripe handles all payment processing and is subject to its own terms and privacy policy.
Subscriptions auto-renew until you cancel. You may cancel at any time through the Stripe customer portal available in your account dashboard. Cancellation takes effect at the end of the current paid period; you retain access to the Service until then.
All charges are non-refundable except where required by applicable law. If you believe a charge was made in error, contact us within 30 days at [email protected].
You are responsible for any applicable taxes. We will provide you with invoices through the Stripe customer portal.
We may change plan pricing with at least 30 days written notice by email to the address on your account. Continued use of the Service after a price change takes effect constitutes your acceptance of the new price.
6. Service availability and fail-open behavior
We operate the Service on a best-effort basis. We do not guarantee a specific uptime percentage in these Terms. We aim to keep the Service reliable and will communicate planned maintenance in advance where practicable.
The Service is designed to fail open: in the event of an internal error, an unreachable dependency, or an over-quota condition, the API returns a safe, non-blocking response rather than an error that would break your form or flow. This design is intentional and means your customers are never blocked by an outage on our side.

7. Customer responsibilities
You are solely responsible for the addresses you submit to the Service. This means you must have a lawful basis for checking each address, consistent with applicable privacy laws and your own privacy policy.
The Service returns a recommended action; you decide how to act on it. You are fully responsible for any decision you make based on a verdict or action returned by the Service, including decisions to block, warn, or permit a user. We are not liable for the consequences of how you apply detection results.
You are responsible for ensuring your use of the Service complies with all laws applicable to you and your users, including data protection and privacy laws.
8. Intellectual property
The Service, including its software, detection logic, domain lists, API design, website, and all related intellectual property, is owned by us or our licensors. Nothing in these Terms transfers any ownership interest to you.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service (including the provided JavaScript snippet) solely for your own internal business purposes, in accordance with these Terms. Any other use requires our prior written consent.
9. Disclaimers, limitation of liability, and indemnification
Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that detection verdicts will be perfectly accurate in every case.
Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising out of or related to these Terms or the Service will not exceed the amounts you paid us in the twelve months immediately before the event giving rise to the claim.
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third party’s rights.
10. Suspension and termination
We may suspend or terminate your account at any time if we believe you have violated these Terms, if required by law, or to protect the integrity of the Service. Where practicable, we will notify you before suspension. If your account is terminated for cause, you are not entitled to a refund.
You may terminate your account at any time through your account settings. On termination your subscription will be canceled, and your data will be handled in accordance with our Privacy Policy.
Sections 4, 7, 8, 9, and 12 survive any termination of these Terms.
11. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email to the address on your account and by posting the updated Terms here with a new effective date. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms will be resolved in the courts of competent jurisdiction located in Texas, and you consent to personal jurisdiction there.
